TERMS OF USE

These Terms of Use (the “Terms”) govern your access to and use of the website located at thechief.pro (the “Site”) and any digital content, books, guides, programs, assessments, or other materials (collectively, the “Content”) made available by THECHIEF.PRO. By accessing the Site or acquiring any Content, you confirm that you have read, understood, and agreed to be bound by these Terms.
1. Acceptance of Terms
These Terms constitute a binding agreement between you and THECHIEF.PRO. If you do not agree with any provision of these Terms, you must not access the Site or use the Content. We may revise these Terms from time to time; continued use of the Site after a revision takes effect constitutes acceptance of the revised Terms. You should review this page periodically.
2. Products and Digital Content
All books, guides, programs, and other digital materials offered on the Site are licensed, not sold, for your personal, non-commercial use only. You receive a limited, non-exclusive, non-transferable, revocable licence to access and read the Content for your own benefit. You may not reproduce, duplicate, copy, sell, resell, redistribute, rent, lease, sublicense, or otherwise commercially exploit any part of the Content, in whole or in part, without our prior written consent.
3. Intellectual Property
The Site, the Content, the brand “THECHIEF.PRO”, the visual identity, the source code, the typography choices, the layout, and all related materials are owned by The Chief and are protected by Italian, European Union, and international copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property right to you, except for the limited licence expressly granted in Section 2.
4. Disclaimer of Warranties
The Site and the Content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim, to the maximum extent permitted by law, all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. The Content reflects the opinions and frameworks of its authors and is provided for informational and educational purposes only. We make no guarantee, representation, or warranty that the use of the Content will produce any specific personal, professional, financial, or performance outcome.
5. Limitation of Liability
To the maximum extent permitted by applicable law, THECHIEF.PRO and The Chief shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Site or the Content, whether based on warranty, contract, tort, statute, or any other legal theory. Where liability cannot lawfully be excluded, it shall be limited to the amount you paid (if any) for the Content giving rise to the claim during the twelve (12) months preceding the event giving rise to liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
6. No-Refund Policy for Digital Goods
In accordance with Article 59(1)(o) of EU Directive 2011/83 and Article 59 of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005), the right of withdrawal does not apply to the supply of digital content not on a tangible medium where performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal. By completing a purchase and accessing the digital download, you expressly consent to immediate performance and you acknowledge that you forfeit your right of withdrawal. All sales of digital Content are therefore final and non-refundable, unless required otherwise by mandatory law or unless we expressly state otherwise at the point of sale.
7. Prohibited Conduct
When using the Site or the Content, you agree not to:
- Use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with any other party's use of the Site.
- Use any robot, spider, scraper, or other automated means to access the Site or Content for any purpose without our express written permission.
- Attempt to gain unauthorised access to, interfere with, damage, or disrupt any portion of the Site, the server on which it is stored, or any server, computer, or database connected to it.
- Reproduce, copy, sell, resell, redistribute, or otherwise commercially exploit any portion of the Content in violation of Section 2.
- Use the Site or Content for any unlawful purpose, or to solicit others to perform or participate in any unlawful acts.
- Remove or alter any copyright, trademark, or other proprietary notices from any portion of the Content.
8. Governing Law and Jurisdiction
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Republic of Italy and, where applicable, by the laws of the European Union. The courts of Italy shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
If you access the Site from the United States, nothing in this Section deprives you of any mandatory consumer protection afforded by the laws of your state of residence. Where local mandatory law provides you with a more protective forum, that local law shall prevail to the extent it cannot lawfully be excluded.
9. Changes to These Terms
We may amend these Terms at any time by posting the revised Terms on this page and updating the “Last updated” date at the top. For material changes we will use reasonable means to bring the revised Terms to your attention. Your continued use of the Site or Content following such posting constitutes acceptance of the revised Terms.
